These Terms of Use ("Terms") are a binding agreement between you and Julio Eduardo Cabrera del Castillo ("we," "us") governing use of Purple Squirrel ("the Service"). By clicking to accept, creating an account, or using the Service, you agree to these Terms and acknowledge the Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Service.
You must be at least 18 years old and able to form a binding contract. By using the Service you represent that you meet these requirements.
You are responsible for the accuracy of the information you provide, for maintaining the confidentiality of your credentials, and for all activity under your account. Notify us promptly of any unauthorized use. We may refuse, suspend, or terminate accounts at our discretion. We may provide notices and messages to you within the Service or via the contact information you provide; you agree to keep that information current.
The Service aggregates job listings from third-party sources, provides tools to organize and track your job search, and offers automated matching, ranking, and document-generation features. The Service is provided free of charge at its base level; we may modify, suspend, or discontinue any feature at any time.
You agree to use the Service only for lawful, personal, non-commercial purposes. You will not: use automated means to access, scrape, or extract data from the Service except through interfaces or features we expressly provide for automated use; probe, scan, or test the vulnerability of the Service or circumvent its security or access controls; impose an unreasonable load on the Service's infrastructure; impersonate any person; resell, republish, or redistribute content obtained through the Service; or use the Service to infringe the rights of others or violate applicable law.
You retain ownership of content you submit (including resume and profile content). You grant us a non-exclusive, worldwide, royalty-free license to host, process, and use that content as necessary to operate, maintain, and improve the Service, including the automated processing described in the Privacy Policy. We may create, use, and commercially exploit aggregated or de-identified data derived from use of the Service without restriction.
Feedback, suggestions, ideas, and survey responses about the Service ("Feedback") are provided voluntarily. You assign to us all right, title, and interest in Feedback, and we may use it for any purpose without restriction, attribution, or compensation. Providing Feedback does not create any employment, contractor, partnership, or other compensated relationship, and we have no obligation to use or implement any Feedback.
Job listings and related information originate from third-party sources or may in the future be posted directly by employers or their representatives using the Service. We do not verify, endorse, or guarantee the accuracy, completeness, currency, or legitimacy of any listing, employer, or third-party site the Service links to. Although we may apply screening or security measures to listings, responsibility for the content and legitimacy of a listing rests with the party that posted it. Your interactions with employers or third parties are solely between you and them and at your own risk; to the maximum extent permitted by law, we are not liable for any loss arising from those interactions.
The Service is an information and productivity tool. We make no representation or guarantee regarding employment, interviews, responses from employers, or the outcome of any application. Automated rankings and generated documents are provided as-is and may contain errors; you are responsible for reviewing anything you submit to an employer.
The Service, including its software, design, branding, and content we create, is owned by us or our licensors. No rights are granted except the limited right to use the Service in accordance with these Terms.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE, MERCHANTABILITY, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED AVAILABILITY, TO THE MAXIMUM EXTENT PERMITTED BY LAW.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, OPPORTUNITY, EMPLOYMENT, OR PROFITS, ARISING FROM OR RELATING TO THE SERVICE. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM WILL NOT EXCEED ONE HUNDRED CANADIAN DOLLARS (CAD $100).
You agree to indemnify and hold us harmless from claims, damages, and expenses (including reasonable legal fees) arising from your unlawful use of the Service or your violation of these Terms.
You may stop using the Service and request account deletion at any time. We may suspend or terminate access at our discretion, including for violation of these Terms. Sections that by their nature should survive termination (including 3, 6, 6a, 7–12 and 15) survive.
We may modify these Terms at any time. Material changes will be presented for acceptance within the Service; continued use after changes take effect constitutes acceptance. The version you accepted, and when, is recorded on your account. You may be required to accept the updated Terms to continue using the Service.
These Terms are governed by the laws of the Province of Saskatchewan and the federal laws of Canada applicable therein. Disputes will be resolved exclusively in the courts of Saskatchewan, and you consent to their jurisdiction. If any provision is held unenforceable, the remainder stays in effect. These Terms and the Privacy Policy are the entire agreement between you and us regarding the Service.
